Kansas City, Missouri – March 2, 2020 – The American Association of Private Lenders (AAPL) and Think Realty announced their second annual Day on the Hill, during which they will meet with the offices of senators and house representatives on the United States Senate Committee on Banking, Housing, and Urban Affairs; the United States Senate Committee on Finance; and the United States House Committee on Financial Services.

The delegation of private lenders, fund managers and real estate investors will converge on Capitol Hill Mar. 19 to advocate for lender- and investor-friendly regulations. Specific agenda items include the Secure and Fair Enforcement for Mortgage Licensing Act (S.A.F.E. Act), the Home Mortgage Disclosure Act (HMDA) and the Investing in Opportunity Act.

“While the aim of the S.A.F.E. Act and HMDA is to protect consumer homeowners, the outcomes of these measures have also resulted in increased regulation for commercial and business-purpose loans made to investors,” said AAPL managing director Linda Hyde. “And our fund managers and real estate investors are seeing barriers to widespread implementation of Opportunity Zone investment via the Investing in Opportunity Act.”

Most regulation that hinders private lenders’ and real estate investors’ business operations is due to legislators’ lack of understanding in what people in these industries do, Hyde said.

“Our largest hurdle is the skewed view of the fix-and-flip industry popularized by reality TV,” said Hyde, “or that legislators don’t realize that the legislation they create to protect consumers is having unintended regulatory impact on non-consumer borrowers.”

Day on the Hill is part of AAPL’s legislative advocacy efforts through the association’s Government Relations Committee. The Committee:

  • Serves as a unified voice for the private real estate lending profession;
  • Impacts state and federal legislation, regulation and policy where it affects the private lending profession;
  • Provides a platform for AAPL members’ participation in the democratic process;
  • Educates and informs public policy makers and citizens with its specialized knowledge; and expertise.
